Agreeing to these terms By downloading or using ContextCat (the "App") you agree to these terms. If you do not agree, do not use the App. Apple's standard licence agreement for apps from the App Store also applies. ## 2\. What the App does ContextCat is a reading app. You can import and store PDFs, links and text, read content in many languages, and get word explanations, translations, answers about your documents, read-aloud audio and review cards. Explanations, translations, answers and audio are produced automatically by AI services. ## 3\. Your content You are responsible for everything you import, upload or store in the App ("your content"), including documents, PDFs, text and links. - You confirm that you own your content or have the rights and permissions you need to use it in the App. - You are responsible for making sure your content does not infringe anyone's copyright, trademark or other rights. - We process your content automatically to provide the App's features, as described in the [privacy policy](https://contextcat.app/privacy). We do not review it by hand, and we do not check or confirm its copyright status. - You keep all rights to your content. ## 4\. What you must not do Do not upload or import content that: - infringes the intellectual property of others; - contains malicious code or harmful software; - is illegal, defamatory or obscene; - contains other people's personal information without their consent; - breaks the terms of the service you got it from. Do not upload content in order to make false infringement claims, test the App in bad faith, misrepresent who owns content, or create artificial evidence of copyright violations. ## 5\. Indemnity You agree to defend and hold harmless ContextCat and its developer against claims, damages, losses and costs (including reasonable legal fees) that arise from your use of the App, your content, your breach of these terms, your infringement of anyone's rights, or any false or bad-faith claim you make. ## 6\. Subscriptions and the free trial - ContextCat is free to download, with limits on some features. ContextCat Pro is an auto-renewing subscription bought through Apple. - Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically unless you cancel at least 24 hours before the end of the current period. - Where a free trial is offered, you are charged when it ends unless you cancel at least 24 hours before. Any unused part of a trial ends when you buy a subscription. - Manage or cancel in your iPhone's Settings, under your name, then Subscriptions. Refunds are handled by Apple. - Fair-use limits apply to some features even on Pro, such as a daily number of questions about documents and hours of new audio. They are set to cover normal reading. ## 7\. No warranty The App is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, non-infringement, uninterrupted or error-free service, or the accuracy or completeness of explanations, translations, answers or audio. Explanations and translations are written by AI and can be wrong. Do not rely on them alone for legal, medical, financial or other important decisions. ## 8\. Limitation of liability To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, for damages from copyright claims about your content, for losses from using or being unable to use the App, or for claims about the accuracy of explanations or translations. Our total liability is limited to what you paid for the App in the twelve months before the claim. ## 9\. Copyright complaints If you believe your copyrighted work has been uploaded to the App by someone else without permission, email [indie.yt.tr@gmail.com](mailto:indie.yt.tr@gmail.com) with: - a description of the work; - where the material is; - your contact details and a statement that you believe in good faith the use is not authorised; - a statement that you did not upload the material yourself; - your physical or electronic signature. Content uploaded privately by a user is visible only to that user. Claims about content the claimant uploaded themselves will be dismissed. False claims may have legal consequences. Users who upload content they have no right to may lose access to the App. ## 10\. Ending access We may suspend or end your access to the App if you break these terms, if your content appears to infringe someone's rights, or for illegal or harmful activity. You can stop using the App at any time and ask us to delete your data, as the privacy policy explains. ## 11\. Third-party services The App relies on third-party services, including AI services such as OpenAI and Google Gemini, for explanations, translations, answers and audio, and on the websites you open for news articles. We are not responsible for their accuracy, availability or terms. ## 12\. Privacy The [privacy policy](https://contextcat.app/privacy) explains what the App collects, why, and how it is protected. ## 13\. Changes We may change these terms. When we do, we update this page and the date at the top. Using the App after a change means you accept the new terms. ## 14\. Governing law These terms are governed by the laws of the place where the App's developer is based. Disputes will be settled by binding arbitration under the rules of the International Chamber of Commerce, or in the competent courts of that place. This does not take away any rights you have as a consumer under the laws of your country. ## 15\. If part of these terms is invalid If any part of these terms cannot be enforced, the rest stays in effect. ## 16\.
